Welcome to Empire Club ("Empire Club," "Company," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the website located at emplreclubusa.com, including all content, products, and services offered on or through the site (collectively, the "Site"). By accessing or using the Site, placing an order, or otherwise using our services, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use this Site and to purchase products from us. By using the Site, you represent and warrant that you meet this requirement and that you have the legal capacity to enter into a binding contract.

2. Account & Order Information

When you place an order, you agree to provide current, complete, and accurate purchase and account information. You are responsible for maintaining the confidentiality of any account credentials and for all activities that occur under your account. We reserve the right to refuse or cancel any order at our discretion, including in cases of suspected fraud, error in pricing or product information, or unauthorized/illegal activity.

3. Products, Pricing & Descriptions

We attempt to be as accurate as possible in describing our products, including pricing, images, and specifications. However, we do not warrant that product descriptions, pricing, or other content on the Site is accurate, complete, current, or error-free. In the event of a pricing error, we reserve the right to cancel any orders placed for the product listed at the incorrect price, and will notify you and issue a full refund if payment has already been collected.

Any statements regarding our products have not been evaluated by the Food and Drug Administration (FDA). Our products are not intended to diagnose, treat, cure, or prevent any disease. 5. Payments

All payments are processed securely through Shopify Payments and/or our authorized third-party payment processors. By providing a payment method, you authorize us to charge the applicable fees, taxes, and shipping costs to that payment method. All prices are listed in U.S. Dollars (USD) unless otherwise stated.

6. Intellectual Property

All content on the Site, including text, graphics, logos, images, and software, is the property of Empire Club or its licensors and is protected by U.S. and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Site without our prior written consent.

You agree to indemnify, defend, and hold harmless Empire Club and its affiliates, officers, and employees from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to its conflict of law principles.

11. Dispute Resolution & Binding Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site shall first be addressed informally by contacting us at support@empireclubcs.com. If a dispute is not resolved within 30 days, both parties agree that any remaining dispute shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small claims court. YOU AND EMPIRE CLUB EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION.

12. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Changes are effective immediately upon posting to the Site. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
